Deposit, Payment of Purchase Price, Fees
Buyer has paid a deposit of $___ 500 ___ with payment of the balance of $_______ due upon release of the Dog to Buyer. The expected delivery date is _______________, or such other date as the parties may mutually agree. Payment of the balance may be made by cash, cashier’s check, money order, or via GoodDog app.
Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the Dog if:
(a) Buyer fails to complete the purchase of the Dog for any reason, or
(b) Buyer fails to pay the balance of the Purchase Price before delivery/pick-up date. In either event, Seller shall be free to sell the Dog to another party.
In the event that the Dog is not available due to sickness, death, or any other circumstance owing to the fault of the Seller, Buyer’s deposit will, at Seller’s option, be either (1) refunded, or (2) transferred to the litter of puppies.
A boarding fee of $25 per day will be charged for each day the Dog is boarded by Seller past the agreed delivery date.
Transfer of Ownership and Registration
Upon payment in full of the Purchase Price, Seller shall promptly provide all AKC registration documentation required for officially transfer ownership and registration (limited), unless unlimited is requested/purchased by Buyer for additional ($500) for breeding purposes of the Dog to Buyer.
Seller’s Representations and Warranties
Seller represents and warrants to the Buyer that:
(a) Seller is the legal and rightful owner of the Dog and that Seller has full right and authority to sell the Dog to the Buyer.
(b) The Dog is being sold free and clear of any lien, security or interest, charge or other encumbrance.
(c) Seller guarantees the Dog to be in good health at the time of sale.
In the event the Dog is found to have Communicable diseases at the time of sale. Buyer has 3 days (72 hours) to report the problem and return the Dog, with a veterinarian-signed medical report. In the event this return, Buyer may return the Dog, which is deemed to be at the sole discretion of the Seller. Seller reserves the right to have Dog examined within the first 72 day period with a veterinarian of Seller’s choice before returning or exchanging the Dog. Seller will give no refund for medical costs and shall not be responsible to the Buyer. This health guarantee will be null and void if the Dog is not examined within 72 hours.
This health guarantee does NOT cover coccidiosis, Eye Entropion, Allergies, undescended testicles, internal/external parasites, hernias, soft palate, umbilical hernia, dermatitis, kennel cough or hypoglycemia. This guarantee does NOT cover behavioral problems or improper socialization. Buyer agrees that they have thoroughly researched the breed, and understands the many health issues they can possess. Buyer is responsible for all medical costs of their puppy. (No refunds will be given.) This guarantee covers only the original Buyer and is not transferable.
(1) To ensure that Buyer does not euthanize the Dog or take it to an animal shelter. Seller will take the Dog back at any time during the Dog’s lifetime. Seller will not issue a refund or provide another Dog to Buyer unless the Dog’s return was a result of any misrepresentation on the part of the Seller with respect to the Dog’s health.
Fitness of Purpose
The Dog was bred as a companion animal, and Seller does not provide any warranty as to the Dog’s fitness for any specific purpose, including obedient traits, show ring performance, and/or breeding purposes.
Buyer’s Representations
Buyer represents to Seller that:
(a) Buyer will have the Dog spayed or neutered only between the age of 12-24 months as large breed dogs need these hormones to properly and fully develop their joints to minimize any risk of arthritis
(b) The Dog will reside with Buyer as a companion pet to Buyer and Buyer’s family.
(c) Buyer will keep the Dog in an enclosed area of adequate size, and will not tether the Dog to roam at will. Buyer will not keep the Dog chained or tethered or permanently house the Dog in a kennel.
(d) Buyer will provide the Dog with nutritious food cooked or raw, necessary veterinary care, including de-worming, heartworm prevention, and regular vaccinations.
(e) Buyer will not sell the Dog to any retail company, dog wholesaler or retailer of dogs, or to an individual whose intention is to resell, trade or give away the Dog, without the written approval of the Seller.
(f) If Buyer transfers possession and ownership of the Dog, the new Buyer must still agree to all the terms in this Agreement. If the Dog is to go to a new owner, Buyer shall ensure that new owner agrees in writing to all the terms of this Agreement.
Indemnity
Any acts or omissions by Buyer after the transfer of Buyer shall result in any claim, suit, loss, damage, injury or liability being Buyer’s sole responsibility. Seller shall not be liable for any such acts or omissions by Buyer. In the event Seller becomes responsible reasonable legal fees, any amount paid in settlement and any other cost incurred by Seller to defend itself, shall be fully reimbursed by Buyer. Buyer shall indemnify and hold Seller harmless for any such acts or omissions including, but not limited to damage to or injury or death of the Dog, any other animal or any person.
Limitation of Action
Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be bought within one (6 months) of the date such claim or loss occurs.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Tennessee.
Entire Agreement
This Agreement represents the entire agreements between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied unless specifically stated in this Agreement.

Entire Agreement
This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied unless specifically stated in this Agreement.
